{"id":8590,"date":"2020-10-29T17:08:57","date_gmt":"2020-10-29T22:08:57","guid":{"rendered":"http:\/\/www.une-sen.org\/press\/?p=8590"},"modified":"2020-10-29T17:08:58","modified_gmt":"2020-10-29T22:08:58","slug":"changes-to-699-leave-psac-to-take-further-legal-action","status":"publish","type":"post","link":"https:\/\/www.unesen.ca\/press\/?p=8590","title":{"rendered":"Changes to 699 leave: PSAC to take further legal action"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"960\" height=\"400\" src=\"http:\/\/www.une-sen.org\/press\/wp-content\/uploads\/2020\/10\/gettyimages-1180387443.jpg\" alt=\"\" class=\"wp-image-8591\" srcset=\"https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/gettyimages-1180387443.jpg 960w, https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/gettyimages-1180387443-300x125.jpg 300w, https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/gettyimages-1180387443-768x320.jpg 768w\" sizes=\"(max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/figure>\n\n\n\n<p>October 29, 2020<\/p>\n\n\n\n<p>PSAC is filing a second policy grievance against Treasury Board for its&nbsp;most recent&nbsp;discriminatory changes to 699 leave that&nbsp;will force federal workers to exhaust all other leave \u2013 including sick leave and vacation leave \u2013 before they can request&nbsp;\u201cother leave with pay\u201d&nbsp;for COVID-19-related reasons.&nbsp;&nbsp;<\/p>\n\n\n\n<p>For&nbsp;the past&nbsp;eight months, federal public service workers have been giving their all to help Canadians grapple with&nbsp;the COVID-19 pandemic.&nbsp;PSAC members have been&nbsp;<a href=\"http:\/\/psacunion.ca\/covid-19-member-stories\" target=\"_blank\" rel=\"noreferrer noopener\">unwavering in their dedication<\/a>&nbsp;despite&nbsp;the physical risks for those doing front-line work, in additional to ongoing&nbsp;school and&nbsp;daycare&nbsp;closures,&nbsp;and the extra burden of taking care of vulnerable family members.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In some cases, workers&nbsp;have been&nbsp;forced to&nbsp;use 699 leave&nbsp;when they simply&nbsp;could not work&nbsp;remotely&nbsp;because of&nbsp;child&nbsp;care&nbsp;or elder care responsibilities,&nbsp;including waiting in long lines for COVID-19 testing.&nbsp;<\/p>\n\n\n\n<p><a href=\"http:\/\/psacunion.ca\/pbo-confirms-modest-use-and-low-cost-699-pandemic?_ga=2.41335713.2074727650.1604003627-1121130890.1580157739\" data-type=\"URL\" data-id=\"http:\/\/psacunion.ca\/pbo-confirms-modest-use-and-low-cost-699-pandemic?_ga=2.41335713.2074727650.1604003627-1121130890.1580157739\" target=\"_blank\" rel=\"noreferrer noopener\">Despite the modest use of 699 leave<\/a>,\u00a0in\u00a0May\u00a0Treasury Board changed the guidelines\u00a0on\u00a0699 leave to restrict how public service workers use \u201cother leave with pay\u201d to\u00a0fulfil\u00a0childcare\u00a0needs related to COVID-19.\u00a0<\/p>\n\n\n\n<p>PSAC&nbsp;warned&nbsp;Treasury Board&nbsp;that&nbsp;tightening&nbsp;the&nbsp;guidelines&nbsp;would discriminate against&nbsp;marginalized&nbsp;groups, potentially lead to serious human rights violations&nbsp;and violate members\u2019 collective agreements.&nbsp;Workers have a right to use 699 leave because we negotiated it into collective agreements; it cannot be taken away at the whim of managers.&nbsp;<\/p>\n\n\n\n<p>They didn\u2019t listen.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Shortly&nbsp;thereafter,&nbsp;PSAC&nbsp;<a href=\"http:\/\/psacunion.ca\/psac-defends-699-leave-covid-related-child-care#:~:text=PSAC%20has%20filed%20a%20policy,needs%20related%20to%20COVID%2D19.\" target=\"_blank\" rel=\"noreferrer noopener\">filed a policy grievance against Treasury Board<\/a>&nbsp;on the grounds that&nbsp;the revised policy&nbsp;disproportionately&nbsp;impacts women, people with disabilities and people with family obligations.&nbsp;&nbsp;<\/p>\n\n\n\n<h3><strong>New policy forces members to exhaust all other leave&nbsp;<\/strong><\/h3>\n\n\n\n<p>Even&nbsp;before PSAC\u2019s&nbsp;<a href=\"http:\/\/psacunion.ca\/legal-battle-begins-protect-use-699-leave-during\" target=\"_blank\" rel=\"noreferrer noopener\">first hearing date with the&nbsp;<\/a>Public Sector Labour Relations&nbsp;and Employment&nbsp;Board,&nbsp;Treasury Board doubled down on their restrictions around 699 leave,&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/government\/publicservice\/covid-19\/employee-illness-leave.html\" target=\"_blank\" rel=\"noreferrer noopener\">revising their policy<\/a>&nbsp;to state that 699 leave could only be considered&nbsp;if workers have depleted all other paid leave available to them, even if they&nbsp;are suffering from COVID-19 symptoms or are unable to work because of&nbsp;child&nbsp;care&nbsp;or family&nbsp;obligations.&nbsp;&nbsp;<\/p>\n\n\n\n<p>PSAC will&nbsp;therefore&nbsp;be filing another policy grievance for the&nbsp;latest 699 leave policy changes&nbsp;that&nbsp;come into effect&nbsp;on&nbsp;November 9.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Every day, parents are pulling their sick kids out of schools and&nbsp;daycares&nbsp;and will be&nbsp;forced&nbsp;to&nbsp;use up their vacation and sick leave.&nbsp;Workers caring for elderly&nbsp;relatives&nbsp;must&nbsp;make the impossible choice&nbsp;of putting their loved ones at risk&nbsp;if they go to work and bring COVID-19 home with them.&nbsp;These changes violate&nbsp;both&nbsp;members\u2019 collective agreements and&nbsp;the Canadian Human Rights Act based on family status, sex and disability.&nbsp;The Canadian Human Rights Commission also plans to make submissions on behalf of federal public service workers.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Without the availability of a vaccine, and with many parts of Canada experiencing a&nbsp;second wave of the pandemic, Treasury Board\u2019s proposed changes are premature and&nbsp;do not&nbsp;reflect&nbsp;the current&nbsp;reality of this&nbsp;public health crisis&nbsp;and its mental health impacts on public service workers.&nbsp;<\/p>\n\n\n\n<p>PSAC is committed to ensuring that our members, and in particular, women, caregivers and those with disabilities, continue to have the necessary support and leave with pay they need during the pandemic.&nbsp;<\/p>\n\n\n\n<p>Source: <a href=\"http:\/\/psacunion.ca\/changes-699-leave-psac-take-further-legal-action\">http:\/\/psacunion.ca\/changes-699-leave-psac-take-further-legal-action<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>October 29, 2020 PSAC is filing a second policy grievance against Treasury Board for its&nbsp;most recent&nbsp;discriminatory changes to 699 leave that&nbsp;will force federal workers to exhaust all other leave \u2013 including sick leave and vacation leave \u2013 before they can request&nbsp;\u201cother leave with pay\u201d&nbsp;for COVID-19-related reasons.&nbsp;&nbsp;
