{"id":8563,"date":"2020-10-19T08:34:08","date_gmt":"2020-10-19T13:34:08","guid":{"rendered":"http:\/\/www.une-sen.org\/press\/?p=8563"},"modified":"2020-11-03T13:22:03","modified_gmt":"2020-11-03T18:22:03","slug":"legal-battle-begins-to-protect-use-of-699-leave-during-the-pandemic","status":"publish","type":"post","link":"https:\/\/www.unesen.ca\/press\/?p=8563","title":{"rendered":"Legal battle begins to protect use of 699 leave during the pandemic"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" width=\"960\" height=\"400\" src=\"http:\/\/www.une-sen.org\/press\/wp-content\/uploads\/2020\/10\/699-leave-news_0.jpg\" alt=\"\" class=\"wp-image-8564\" srcset=\"https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/699-leave-news_0.jpg 960w, https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/699-leave-news_0-300x125.jpg 300w, https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2020\/10\/699-leave-news_0-768x320.jpg 768w\" sizes=\"(max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/figure>\n\n\n\n<p>October 16, 2020<\/p>\n\n\n\n<p>PSAC\u2019s legal challenge against Treasury Board\u2019s regressive and discriminatory changes to 699 leave for federal public service workers is set to&nbsp;begin&nbsp;October 19.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In June, PSAC filed a&nbsp;<a href=\"http:\/\/psacunion.ca\/psac-defends-699-leave-covid-related-child-care#:~:text=PSAC%20has%20filed%20a%20policy,needs%20related%20to%20COVID%2D19.\" target=\"_blank\" rel=\"noreferrer noopener\">policy grievance<\/a>&nbsp;after the government tightened its guidelines around when public service workers can use \u201cOther Leave with Pay\u201d (699 leave) to&nbsp;fulfill&nbsp;child care&nbsp;needs&nbsp;during the pandemic.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The new policy&nbsp;fails&nbsp;to&nbsp;recognize that some parents may have to keep their children at home for legitimate reasons despite the availability of schools or&nbsp;child care. For example, some parents may choose to&nbsp;keep their children at home to protect members of their household who suffer from underlying health conditions that make them vulnerable to COVID-19 symptoms.&nbsp;&nbsp;<\/p>\n\n\n\n<p>PSAC&nbsp;will meet with&nbsp;the&nbsp;Federal&nbsp;Public Sector Labour Relations and Employment Board&nbsp;in order to determine the scope of the policy grievance and&nbsp;set dates for the hearing.&nbsp;&nbsp;<\/p>\n\n\n\n<p>PSAC made it clear that the&nbsp;new&nbsp;policy adversely impacts women who continue to bear a disproportionate burden of domestic responsibilities including&nbsp;child&nbsp;care, eldercare and household&nbsp;operations. It could also result in discriminatory outcomes for people with disabilities and people with family obligations, violating both members\u2019 collective agreements and the&nbsp;<a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/h-6\/\" target=\"_blank\" rel=\"noreferrer noopener\">Canadian Human Rights Act<\/a>&nbsp;based on family status, sex and disability.&nbsp;The Canadian Human&nbsp;Rights Commission&nbsp;has also&nbsp;notified the Board that&nbsp;it intends on making submissions&nbsp;on this issue.&nbsp;<\/p>\n\n\n\n<p>The proposed policy amendments&nbsp;would&nbsp;result in a patchwork of unfair outcomes&nbsp;for public service workers and give managers too much discretion in applying the policy.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>PSAC pushes back against&nbsp;the&nbsp;use of sick leave for COVID-19&nbsp;<\/strong><\/p>\n\n\n\n<p>PSAC will also&nbsp;be contesting&nbsp;language in the policy that&nbsp;says employees who are experiencing COVID-19 symptoms or who&nbsp;self-isolate would&nbsp;be required to use&nbsp;available&nbsp;sick leave instead of 699 leave&nbsp;if they&nbsp;are unable to&nbsp;work.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This egregious change to the policy is discriminatory to public service workers and&nbsp;flies in the&nbsp;face&nbsp;of sound public health advice. Without the availability of a&nbsp;vaccine,&nbsp;and&nbsp;with&nbsp;many parts of Canada entering a second wave of the pandemic, Treasury Board\u2019s proposed changes are premature and inconsistent with the current public health crisis.&nbsp;&nbsp;<\/p>\n\n\n\n<p>There&nbsp;is&nbsp;also no evidence that employees have abused 699 leave during the pandemic.
