{"id":5025,"date":"2015-07-08T12:00:55","date_gmt":"2015-07-08T17:00:55","guid":{"rendered":"http:\/\/www.une-sen.org\/press\/?p=5025"},"modified":"2015-08-05T07:34:12","modified_gmt":"2015-08-05T12:34:12","slug":"psac-launches-court-action-against-bill-c-59","status":"publish","type":"post","link":"https:\/\/www.unesen.ca\/press\/?p=5025","title":{"rendered":"PSAC launches court action against Bill C-59"},"content":{"rendered":"<header id=\"main-content-header\">\n<h1><img loading=\"lazy\" class=\"alignnone size-full wp-image-5034\" alt=\"CourtC-59\" src=\"http:\/\/www.une-sen.org\/press\/wp-content\/uploads\/2015\/07\/CourtC-59.png\" width=\"600\" height=\"375\" srcset=\"https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2015\/07\/CourtC-59.png 600w, https:\/\/www.unesen.ca\/press\/wp-content\/uploads\/2015\/07\/CourtC-59-300x187.png 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/h1>\n<h1 id=\"page-title\"><span style=\"font-size: 16px;\">Today, the Public Service Alliance of Canada (PSAC) has taken the first step in its legal challenge against\u00a0<\/span><a style=\"font-size: 16px;\" href=\"http:\/\/psacunion.ca\/public-service-unions-condemn-bill-c-59\">Bill C-59<\/a><span style=\"font-size: 16px;\">, the legislation that is gutting the collective bargaining rights of federal public service workers.<\/span><\/h1>\n<\/header>\n<div id=\"content\">\n<div id=\"block-system-main\">\n<div role=\"article\">\n<p>The PSAC filed its constitutional challenge to Bill C-59 in the Ontario Superior Court of Justice.<\/p>\n<p>\u201cThe Supreme Court has confirmed that the right to collective bargaining is a protected right under the Charter \u2013 and we are defending that right through all legal means at our disposal,\u201d said Robyn Benson, PSAC National President.<\/p>\n<p>Bill C-59 gives the Conservative government the power to amend certain provisions in federal government collective agreements to remove sick leave and impose a short and long-term disability plan outside of collective agreements. The Bill will circumvent the Public Service Labour Relations Act as well as ongoing negotiations.<\/p>\n<p>The PSAC is requesting the Court to immediately declare that Bill C-59 is in direct violation of our members\u2019 Charter rights by:<\/p>\n<ul>\n<li>Denying employees\u2019 right to good faith bargaining by giving the employer the unilateral authority to establish all terms and conditions related to sick leave, including establishing a short-term disability program and modify the existing long-term disability program<\/li>\n<\/ul>\n<ul>\n<li>Allowing the Treasury Board to nullify terms and conditions in existing collective agreements without any consultation with bargaining agents; and<\/li>\n<\/ul>\n<ul>\n<li>Giving the employer the authority to override many provisions of the PSLRA, including the statutory freeze provisions that maintain the\u00a0status quo\u00a0while the parties are engaged in collective bargaining.<\/li>\n<\/ul>\n<p>More updates will follow as the case progresses.<\/p>\n<p>Source: www.psacunion.ca<\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Today, the Public Service Alliance of Canada (PSAC) has taken the first step in its legal challenge against\u00a0Bill C-59, the legislation that is gutting the collective bargaining rights of federal public service workers.
